Digital advertising has relied on third-party cookies for years to track users across the web. Advertisers use these cookies to follow user behaviour, build audience segments, and serve targeted ads. This tracking happens largely without explicit user consent or awareness. That era is ending. Regulatory pressure from GDPR in Europe, CCPA in California, and similar regulations in other jurisdictions has made third-party cookie tracking legally risky. Browser manufacturers, led by Apple and soon to be followed by Google, are removing third-party cookie support. Safari has already disabled third-party cookies entirely. Firefox blocks them by default. Google announced a multi-year phase-out of third-party cookies in Chrome, culminating in 2026.

Beyond regulation and browser changes, user attitudes toward data privacy have shifted dramatically. Consumers increasingly oppose data collection and targeted advertising. They use adblockers, privacy-focused browsers, and VPNs to limit tracking. They support stricter data privacy regulations. This shift in consumer sentiment combined with regulatory pressure and browser changes means the old tracking-based advertising model is genuinely ending. Marketers who relied primarily on third-party cookie targeting and cross-site behaviour tracking are losing their primary competitive advantage. This creates both a challenge and an opportunity. The challenge is losing the tracking infrastructure that enabled convenience. The opportunity is building marketing approaches that do not depend on invasive tracking.

First-party data strategy

First-party data is information that customers willingly share with you directly. Email addresses, phone numbers, purchase history, preferences, and communication engagement all constitute first-party data. This is data you own. It is not dependent on third-party platforms. It is not vulnerable to browser changes or regulatory restrictions. Building first-party data assets is the single most important marketing investment businesses can make in 2026.

Email remains the highest-ROI marketing channel precisely because it is first-party data. Every subscriber on your email list chose to hear from you. You own that relationship. You can message them regardless of platform changes, algorithm updates, or regulatory shifts. Building your email list should be a core objective for every business. Offer valuable incentives for email signup. A content upgrade (downloadable guide, template, checklist) in exchange for email is effective. A discount code for first-time buyers incentivizes email signup at the cost of discounted revenue. A free trial with email required gets prospects into your product while capturing their address.

Your CRM system is equally critical. Capture every customer interaction. Track website behaviour, support interactions, purchase history, and communication preferences. Layer in survey data about preferences and interests. The result is a rich customer profile that enables personalised marketing without reliance on third-party data. Direct customer communities also generate first-party data. A private Facebook group, Discord community, or forum for your customers creates connection and generates insights about customer needs, preferences, and pain points. This community data is invaluable. Post-purchase surveys asking about satisfaction, alternative products considered, and future needs generate customer insights. Website exit surveys asking why users left provide competitive intelligence. Preference centres where customers control what communications they receive respect privacy while enabling better targeting.

Future-proofing your marketing

Server-side tracking is the technical evolution beyond third-party cookies. Rather than using browser-based pixel tags that track users across sites, server-side implementation sends data directly from your servers. Google Analytics 4 supports server-side implementation. Certain ad platforms are moving toward server-side conversions. This approach respects privacy regulations while enabling you to measure campaign effectiveness. Server-side tracking is more complex to implement than browser-based pixels, but it is more reliable and privacy-compliant. If you work with a technical team or agency, implementing server-side tracking should be a priority.

Contextual targeting replaces behavioural targeting. Rather than targeting users based on their browsing history across the web, contextual targeting targets based on the content they are viewing right now. A user reading an article about fitness gets shown fitness-related ads. A user viewing a recipe page gets shown cooking equipment ads. This approach respects privacy because it does not track users across sites. It remains effective because context is often predictive of intent. Contextual targeting is having a renaissance as privacy concerns increase and cookie-based targeting becomes unavailable.

Consent platforms let you respect what people have chosen and still collect what you genuinely need. A consent management solution asks users what data collection and tracking they consent to. Users who opt into tracking provide data. Users who opt out are still treated respectfully but receive contextual rather than behavioural targeting. This approach respects privacy, complies with regulations, and often improves user relationships. Users appreciate brands that ask permission and respect their preferences. Finally, invest in authenticated experiences. Require users to create accounts, log in, and provide explicit data. Users provide more data to services they choose to log into versus anonymous experiences. Gmail, Facebook and Spotify all rely on this. You own first-party data from authenticated users. Build experiences valuable enough that users want to log in.
